RENTAL TERMS AND CONDITIONS

“DRIVINGMADEIRA® Rent-a-car” is a registered trademark of FBI-AUTOMOVEIS UNIPESSOAL LDA.

a) MINIMUM RENTAL PERIOD
The minimum rental period is 1 day (24h). For late returns over 29 minutes, an extra day will be charged.
The rental ends on the day , hour and location agreed on the contract. To extend the rental period, the client is required to request the company’s permission in advance and before the return date agreed. If not, it will be considered that the car is circulating without the consent of the company, this being punishable by the terms stated in article 58º, nº7 of the Portuguese Highway code.

b) DOCUMENTS
All drivers must present a Driver´s license valid in Portugal until the end of the rental, together with an identity card or passport.

c) AGE REQUIREMENTS
21 years of age and 1 year valid driving license.

d) FUEL
Vehicles should be returned with the same fuel as they had when given to the client. If not the client must pay the missing fuel. If the car is retured with more fuel than agreed, it will not be refunded. If the vehicle is supplied with the wrong fuel type, the customer will be responsible for the payment of damages caused to the car, regardless of the additional coverages subscribed.

e) AFTER HOURS
For deliveries and/or returns out of the working hours (9am – 6pm), an extra fee will be charged.

f) CANCELLATION
Cancellation is refundable with 48 hour prior notice to pick up time. No show or no prior notice will be subject to a 50€ fee.

PRICES INCLUDE
Vat, limited public liability cover, full maintenance and 24h road assistance.

PRICES DO NOT INCLUDE
a) COLISION DAMAGE WAIVER (CDW) ¹
Optional. Extra costs apply per day. In case of accident the client is only responsible up to a maximum charge of the of €1000 to €2500 (depending on the type of vehicle). If accepted, the client is liable to pay damages up to the amount of the franchise. The values depend of the type of car rented.

b) THEFT PROTECTION(TP) ¹
Optional. Extra costs apply per day. In case of theft of the vehicle or it’s parts, fire or acts of vandalism, the costumer is only responsible up to the minimum excess charge.

c) SUPER DAMAGE WAIVER (SCDW) ¹
Optional. Extra costs apply per day. If CDW and TP are included/accepted in the rate, the client can choose this option to eliminate the excess. This option may not be available for all vehicles.

d) PERSONAL ACCIDENT INSURANCE (PAI) ¹
Optional. Extra cost apply per day. Covers death or disablement and medical expenses for driver and passengers.

e) AIRPORT SERVICE CHARGE (TAXA APT) ¹
Pick-up and drop-off in the airport have an additional cost.

f) BABY SEATS AND BOOSTERS¹
Available on request when booking your reservation. Daily costs applied. The installation of any baby seat or booster seat is the responsibility of the driver.

g) ADDITIONAL DRIVER¹
Additional cost applied per day and per driver.

h) Parking fees, fines, washing, fuel, and loss of keys or documents will be charged to customer regardless of the additional coverages subscribed.

i) Tire damage, not resulting from the normal usage of the vehicle (regardless of the additional coverages subscribed).

j) The client will always be responsible for damages caused to third parties and/or in the hired car when:
-being driven by a person who is not legally qualified or authorized by “DRIVINGMADEIRA® Rent-a-car” .
-suffering damages intentionally caused by the client or any person whom he is responsible for.
-the driver is under influence of alcohol, narcotics or is mentally insane.-being used in sportive competitions, rallies, races or challenges.
-suffering an accident which is not communicated to “DRIVINGMADEIRA® Rent-a-car” as soon as possible.
-suffering vandalism acts on the vehicle such as broken windows, blown up tires or broken wheels.
– It is expressly forbidden to smoke inside the rental car, evidence of such conduct implies the payment of 100€ for the washing of the interior, regardless of the type of insurances the client paid.

k) The lack of or late communication will oblige the client to pay all the expenses that may occur from any of the cases above mentioned. l) Client is responsible for the traffic fines.

m) If the vehicle is found being used in violation of any of this contract’s terms, “DRIVINGMADEIRA® Rent-a-car” may resolve the contract and repossess the vehicle, at any time, anywhere, without notice and at the hirer’s expenses.

n) Casos de assistência em situações de negligencia tais como: descarga de bateria por esquecimento de luzes ligadas, uso abusivo de travões ou embraiagem.

OTHER ADVICES

IN CASE OF ACCIDENT YOU MUST
– Call the authorities (112)
– Call an ambulance in case of personal injuries
– Contact “DRIVINGMADEIRA® Rent-a-car” (if not, you will be held responsible for all damages in the vehicle)
– Ask from other driver(s) involved in the accident:
a) name, address and phone number.
b) driver’s license number, date and place of issue
c) characteristics and registration number of the other vehicle(s).
d) insurance number and company

It is settled between the company and the client that jurisdiction regarding this contract or any other matter regarding the driving Madeira will be settled in Tribunal Judicial do Funchal.
